Terms and Conditions
The Kitchen Garden Cottages – Booking Contract – Terms and Conditions:
Bookings are not confirmed until the deposit is paid in full to the Owner. Your agreement to the Terms and Conditions of the booking occurs automatically when you submit the initial enquiry to the owner.
This agreement is made between Dean Woodrow (the owner) who arranges private bookings of The Kitchen Garden Cottages, Empacombe, Mt Edgcumbe, Cornwall PL10 1HS (the property). The owner of The Kitchen Garden Cottages is responsible for the administration of the booking. When making a private booking through the owner you are entering into a contract with the owner of that property. References to “you” and “your” mean the person making the booking and entering into a contract with the owner.
Whereby it is agreed as follows: –
The booking dates are set as per agreement by email between the “owner” and “you” the person making the booking.
The booking is from no earlier than 4pm on the day of arrival until – no later than 10am on the day of the departure unless otherwise agreed by email between the owner and you the person making the booking.
The first payment, the deposit which equals 30% of the full rental amount is payable within 48 hours of the booking being confirmed between the owner and you the person making the booking.
The second balance payment is due six weeks prior to the visiting arrival date along with the £150 holding fee, which will be returned to you within 14 days of the end of your stay trusting everything is in good order.
Once confirmation of your booking has been received by email and the deposit is paid, the deposit is non refundable if cancelling your stay. Once the full balance is paid (six weeks before arrival) this is then non refundable unless the dates can be re-let at the same value.
The size of your party booking must be pre agreed with the owner, you must not allow extra guest staying in the Cottage or visiting the Cottage without prior consent from the owners. The booking is non transferable.
The Cottages are strictly “No smoking” properties.
All heating and electricity costs are included in the booking price along with one net of logs in the winter months.
Situated outside the kitchen window there are two large green wheelie bins for all of your general rubbish, which must be securely tied in Black Bin liners (Strictly No carrier bags or loose rubbish).
All rubbish and recycling must be removed from the Cottages at the end of your stay. The green wheelie bins with general rubbish are to be put outside the small main gate on Tuesday nights for early collection on Wednesday mornings.
Recycling must be sorted properly into appropriate bags.
Reusable recycling bags are situated next to the bins, one for cardboard, one for papers and one for plastics and tins. There is a black recycling box for all glass and bottles (No broken glass please). Recycling comes fortnightly on the same day as the bins.
Clean fresh bed linens and fluffy bath and hand towels are provided, please do not take these towels outside of the Cottage and please bring your own beach towels.
Do not take soft furnishings out of the house or into the garden e.g. blankets, pillows, cushions.
Parking for Bay Cottage is within the gated folly wall only and on the hard standing (not on the grass), do not park outside the gates as this is neighbor’s parking and inconvenient for them. Parking for Bay Stables in in the lay-by next to the gate.
Empacombe is a quiet friendly community. Respect the residents, keep noise to a minimum and keep speeds down to 10mph at the Harbour. Please watch out for children and animals on the road.
All the gates at Bay Cottage are very old listed gates so must always be kept shut when not in use to avoid damage and for security reasons. The main gate must be secured with both the top bolt and the arm latch.
Balls must not be kicked, thrown or batted against the garden and house walls and care must be taken of windows when playing in the garden.
Before you arrive the property will have been thoroughly cleaned and the inventory checked. Discrepancies and any damage found should be reported within 24 hours of arrival to Bay Cottage to the owner. The inventory will otherwise be deemed to be correct.
Bay Cottage is a very old character property in the middle of beautiful countryside; as a consequence you are close to nature and subject to spiders and other insects and wildlife inside the property. Although thoroughly cleaned before each arrival no guarantee can be given of such eventualities nor any liability accepted.
Any losses, damage or any cleaning necessary over and above normal servicing, will be invoiced to you on or as soon after departure as possible. By accepting these Terms and Conditions you allow us to obtain payment from you to correct the damage made.
You are liable for the full cost of any damage caused to or within the property or gardens during the letting. By accepting these Terms and Conditions you agree to us taking payment for any damages from you to the value of £2000. You acknowledge that this does not limit your liability for damages in excess of this amount. The owner will invoice the cost of any damage to you on or as soon after departure as possible.
Well-behaved pets are welcomed at The Kitchen Garden Cottages at the additional charge of £30 per pet per week. Please notify owner by email if you will be bringing a pet. Dogs must be well behaved and kept under control at all times, are not allowed upstairs or on the furniture, and must not be left unaccompanied in the property at any time. Dogs must be cleaned up after in the garden and waste disposed of properly. Any excess cleaning over and above will incur an additional fee, which will be invoiced to you by the owner or a cleaning company on or as soon after departure as possible. Please notify of any pet accidents or damage on your departure and use carpet-cleaning products to minimize staining to carpets. Dogs must be on a lead at the Harbour at Empacombe.
There are high walls and deep water in and around the garden. There is a small shallow pond outside the dinning window and a deep well (which is securely covered) in the Orchard.
Use of the Cottages is entirely at the Guest’s own risk, the owner can take no responsibility or liability for loss or injury to persons or effects whilst staying at Bay Cottage. Parents of young children are responsible for their safety and are not to leave them unattended in the house or the garden.
You must allow the owner or their contractor access to the property at reasonable hours of the day to carry out unforeseen repairs or other works to the property or appliances (at least 24 hours notice will normally be given, but guests must give immediate access in an emergency).
Guests are expected to keep and leave the Cottage and garden in a clean and tidy condition. All breakages and damage must be reported to the owner as soon as possible. Failure to do so could result in charges.
If there is any breach of these terms and conditions stated including, but not limited to vandalism or disturbance, the owner reserves the right to enter the property and terminate the Holiday with no refund and without prejudice to other rights and remedies of the owner. Complaints must be notified immediately, not after the holiday.
The person making the booking certifies that he or she is authorized to agree the Terms and Conditions on behalf of all persons included in the party, including those substituted or included at a later date (only with prior consent of the owner). He or she agrees to take responsibility for the party occupying the property.
You should read this document carefully and thoroughly, once accepted this agreement will be a legally binding contract and may be enforced in a court of law.
